Terms of Service & Research Compliance Policy

These Terms of Service (“Terms”) govern your access to and use of prismlabsusa.com (the “Site”) and every purchase you make from Prism Labs USA (“Prism Labs,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, and every policy referenced here. If you do not agree, do not use the Site or purchase any product.

1. Research Use Only

All products sold by Prism Labs, including peptides, peptide blends, reconstitution supplies, and any other materials (together, “Products”), are sold strictly for in-vitro laboratory research, analytical testing, and scientific reference.

• No Product is approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority for human or veterinary use.
• Products are not drugs, dietary supplements, foods, cosmetics, or medical devices, and are not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition.
• Products must never be administered to, injected into, ingested by, inhaled by, or applied to humans or animals.
• Statements on this Site have not been evaluated by the FDA. Product names, descriptions, purity figures, and Certificates of Analysis describe the material only. They are not claims of safety, efficacy, or suitability for any use other than laboratory research.

By placing an order, you represent and warrant that you will use the Products only for lawful in-vitro research and analytical purposes, in a properly equipped research setting, and in compliance with all applicable federal, state, and local laws and regulations.

2. Zero-Tolerance Policy on Dosing and Human-Use Inquiries

Prism Labs does not and will not provide dosing, administration, reconstitution-for-injection, cycling, “protocol,” or any other guidance on using Products in humans or animals.

If you, in any communication with us (including email, contact forms, live chat, social media, reviews, or order notes):

• ask for dosing, administration, or human or animal usage advice;
• describe or imply personal, human, or animal use of any Product; or
• request that a Product be used for any purpose other than laboratory research,

then we may, at our sole discretion and without further notice:

• immediately cancel any pending or unshipped orders (with a refund of the amount paid, less any non-recoverable processing fees);
• permanently close your account and refuse all future orders from you, your household, your shipping and billing addresses, and any associated payment methods; and
• retain records of the communication as needed to enforce this policy.

Our support team will answer only questions about orders, shipping, documentation, storage conditions of the material as shipped, and Certificates of Analysis.

3. Buyer Qualifications and Age Verification (21+)

To access the Site or purchase Products, you must:

• be at least 21 years of age;
• be a researcher, laboratory professional, or institution with the training, facilities, and equipment to handle research chemicals safely; and
• have the legal capacity to enter into a binding contract.

You must confirm your age and research-use acknowledgment at the Site’s entry gate and again at checkout. We record these confirmations, including date, time, and IP address, as described in our Privacy Policy. We may request additional verification, such as proof of age, institutional affiliation, or intended research use, and may cancel any order if verification is not provided or is unsatisfactory.

Buyer responsibility for safety. You assume full and sole responsibility and liability for the receipt, handling, storage, use, and disposal of all Products. This includes compliance with appropriate laboratory safety protocols, personal protective equipment, labeling, temperature-controlled storage, chemical hygiene plans, and hazardous-waste regulations. You agree that Products will be accessible only to qualified individuals.

4. Orders, Pricing, and Availability

• All orders are subject to acceptance by Prism Labs. We may refuse, limit, or cancel any order for any reason, including suspected misuse, suspected fraud, verification failure, or pricing and listing errors.
• Prices are listed in U.S. dollars and may change at any time without notice. Multi-unit (“Bundle & Save”) discounts apply only as displayed at checkout.
• Product images may be representative. Lot numbers, packaging, and labels may vary.
• We may limit quantities per order or per customer.
• We ship only to addresses within the United States, and only where the sale and possession of the Products is lawful. You are responsible for knowing and complying with the laws of your jurisdiction.

5. Payment Processing and Chargeback Policy

Payment processing. Payments are processed by independent third-party payment gateways and processors. Your card number is transmitted directly to the processor over an encrypted connection and is never stored on our servers. Your statement may display a billing descriptor that differs from the Prism Labs name.

Authorization. By submitting payment, you represent that you are authorized to use the payment method and you authorize us and our processors to charge the full order amount, including taxes and shipping where applicable.

Fraud prevention. We may use address verification, card security codes, 3-D Secure, IP and device checks, and manual review. We may delay, verify, or cancel any order flagged for possible fraud.

Chargebacks. If you have a problem with an order, contact us first at prismlabsusa@gmail.com or through our contact page. Most issues can be resolved quickly. If you file a chargeback or payment dispute instead of contacting us:

• we will contest any dispute we believe is invalid, and may submit to the card issuer your order details, IP address, the age and research-use confirmations you made, delivery confirmation, tracking data, and your communications with us;
• your account may be suspended and future orders refused while the dispute is open, and permanently if the dispute is found to be unfounded; and
• to the extent permitted by law, you agree to reimburse us for amounts wrongfully charged back, together with reasonable fees and costs incurred in recovering them.

Filing a chargeback for an order that was delivered as described, or for an order you placed and later regret, is a breach of these Terms.

6. Shipping, Risk of Loss, Returns, and Refunds

• Title and risk of loss pass to you when the order is delivered to the carrier.
• Because of the nature of research materials, opened, used, or tampered Products cannot be returned.
• Damaged, defective, or incorrect items must be reported within 7 days of delivery, with photographs, so we can make it right.
• Additional details, where published, appear in our Refund and Shipping policies, which form part of these Terms.

7. Documentation and Certificates of Analysis

Certificates of Analysis (COAs), purity figures, and lot information are provided for research reference and reflect the specific lot tested by the testing laboratory on the date of testing. They do not guarantee that any Product is suitable for any particular use, and they are not a warranty of results in your research.

8. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, ALL PRODUCTS, DOCUMENTATION, AND SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PRISM LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PRODUCT WILL PRODUCE ANY PARTICULAR RESEARCH RESULT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• PRISM LABS, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF RESEARCH, ARISING FROM OR RELATED TO THE SITE OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES;
• PRISM LABS WILL NOT BE LIABLE FOR ANY INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE RESULTING FROM ANY USE OF A PRODUCT CONTRARY TO THESE TERMS, INCLUDING ANY HUMAN OR ANIMAL USE; AND
• OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO A PRODUCT OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the smallest amount permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Prism Labs and its owners, members, officers, employees, agents, suppliers, and affiliates from and against all claims, demands, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• your purchase, receipt, handling, storage, use, misuse, resale, or disposal of any Product;
• any human or animal use of any Product by you or anyone who obtains it through you;
• your violation of these Terms or of any law or regulation; or
• any false statement you make, including about your age or intended use.

11. Account Termination

We may suspend or terminate your access to the Site and cancel any order at any time if we believe you have violated these Terms, provided false information, or present a legal, safety, or fraud risk. Sections 1, 2, 3 (buyer responsibility), 5 (chargebacks), and 7 through 14 survive termination.

12. Resale

Products may not be resold for, labeled for, or marketed for human or animal use. If you resell or transfer any Product, you are solely responsible for ensuring the recipient is a qualified researcher who accepts these same research-use restrictions.

13. Intellectual Property

All Site content, including text, graphics, logos, product images, vial and label designs, and documentation layouts, belongs to Prism Labs or its licensors and may not be copied, reproduced, or used without our written permission.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Before filing any claim, you agree to first contact us and try to resolve the dispute informally for at least 30 days. Any claim that is not resolved informally will be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in any class or representative proceeding.

15. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new effective date. The Terms in effect when you place an order apply to that order. Continued use of the Site after changes are posted means you accept the revised Terms.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any provision is not a waiver. These Terms, together with the policies referenced in them, are the entire agreement between you and Prism Labs regarding the Site and the Products.
